Evaluation of financing and investment contracts in the BOT method, focusing on municipalities

فراهم نمودن فرصت‌هاي جديد سرمايه‌گذاري و مشاركت بخش خصوصي در پروژه‌هاي مختلف در حوزه شهرداري‌ها، يكي از راهكارهاي موثر در تامين منابع مالي و توسعه اقتصادي كشور مي‌باشد. جهت ايجاد بستر مناسب براي جذب سرمايه و تخصيص بهينه منابع مالي مي توان از مشاركت بخش خصوصي با نهادهاي عموممي در ساخت و ايجاد پروژه‌ها استفاده كرد. بر اين اساس انعقاد قراردادهاي BOT به عنوان يكي از راهكارهاي جلب سرمايه خارجي و بهر ه برداري از مديريت كارآمد بخش خصوصي، مورد توجه ويژه مي‌باشد. در اين پژوهش ضمن برر‌سي ادبيات مرتبط با اين نوع قراردادها به ارائه توضيحات لازم مبني بر ضرورت ا‌ستفاده از قراردادهاي مشاركت عمومي و خصو صي در پروژه‌ها پرداخته شده است. در ادامه، انواع قراردادهاي سرمايه گذاري نهادهاي عمومي با بخش خصوصي‌، معرفي‌ و سپس موارد مهم و مورد نياز در قراردادهاي سرمايه‌گذاري به روشBOT جهت تامين مالي پروژه‌ها ارزيابي مي‌گردد.

Providing new opportunities for investment and participation of the private sector in various projects in the field of municipalities is one of the effective solutions in providing financial resources and economic development of the country. In order to create a suitable platform for attracting capital and optimal allocation of financial resources, it is possible to use the participation of the private sector with public institutions in the construction and creation of projects. On this basis, concluding BOT contracts as one of the methods of attracting foreign capital and benefiting from the efficient management of the private sector is of special interest. In this research, while examining the literature related to this type of contracts, the necessary explanations have been provided regarding the necessity of using public and private partnership contracts in projects. In the following, the types of investment contracts of public institutions with the private sector are introduced and then the important and required items in investment contracts using the BOT method to finance projects are evaluated.
