Circumcision and Criminal Law

Abstract
Male children in Muslim and Jewish communities are generally circumcised with the consent of their parents. The German Köln Federal Court has accepted that the act of circumcision is illegal, and that the elements of malicious injury are present with regards to both the circumciser and the consenting parents. However, by the application of Article 17 of the German Criminal Code with regards to error in law the Court has decided not to punish the physician whom has executed the act of circumcision and the consenting parents. This article will discuss the situation under Turkish Law which includes parallel provisions with the German Criminal Code and the German Civil Code.
