Abstract :
“Property Right” and in this context the term ‘’property ownership’’ which is now accepted as a human right is being protected by civil laws and criminal laws which is also arrenged by our constitution in common with the international arrengements. Crimes against the property ownership are regulated in the tenth part of the second section of second book of Turkish Criminal Code (TCC) numbered 5237, as ” larceny (article. 141-147)”, “plunder (article 148-150)”, “Damage to Property (article 151-153)”, “invasion of a place (article 154)”, “misuse of trust (article 155)”, “use of blank bill (article 156)”, “fraud (article 157-159)”, “possesion on a lost or inadvertently found property (article 160)”, “Benefiting from a service without compensation (article 163)”, “declaration of incorrect information about the company or cooperatives (article 164)”, “purchase or acceptance of property acquired committing an offense (article 165)” and “failure in notification (article 166)”. Mainly, the general characteristics of the personal property crimes are to protect the wealth of the personal property and to penalize the acts that may decrease the value of the personal property. Larceny is the most common form of the crimes against the personal property. For this reason, from past to present, larceny constitutes the most significant portion of the crimes against personal property. Here in this article, we shall compare the crimes of “plunder (article 148-150)”, “Damage to Property (article 151-153)”, “misuse of trust (article 155)”, “fraud (article 157)”, “possesion on a lost or inadvertently found property (article 160)”, “Benefiting from a service without compensation (article 163)” with “Larceny” as they all in close connection with and they destroy or cut down the benefits of goods of others.
