Consensual Criminal Procedures and Their Influence on Criminal Prosecutions
Abstract :
Turkish Criminal Procedure Law is based on mandatory prosecution. The suspect as a party has only a limited influence on the commencement of an investigation or prosecution against himself. In this paper we will focus on simplified procedures where the defendant may play a leading role on the outcome of investigation or on the prosecution with his free will. Recent developments in mediation and plea-bargaining procedures in United States and in Germany may be a good model for legislator in Turkey.
