Abstract
The offence of benefiting from a service without compensation is legislated in each Turkish Criminal Codes no. 765 and 5237 and woke controversy about how should offence of benefiting from a service without compensation separate from offence of fraud and some acts should consider in civil case or not. The core point in court’s decisions and jurisprudence is that, until the code no. 6352 was codified, if all kinds of energy with economic value is also considered movable property and this kind of act should punish for offence of larceny. The aim of this article is to review and criticise the offence of benefiting from a service without compensation with the last codifications.
