Abstract :
Law Regarding Organization and Functions of the Turkish Football Federation (“Federation”), dated 5th May 2009, Law No. 5894 states that the Federation is an autonomous institution, which is subject to private law, having legal personality. However it should not be concluded that the Federation is a private law legal person from this point of view. When the organization, duties and powers of the Federation are taken into consideration, it is concluded that the Federation is a public corporation. Although the Arbitral Tribunal of the Federation (“Arbitral Tribunal”) is within the administrative organization organically, it performs a judicial duty. Decisions of the Arbitral Tribunal are final and definitive. Law-maker is the one who may determine whether the decisions can be appealed or not. On the other hand a regulation enabling an action for annulment, as per the Article 439 of the Code of Civil procedure, against the decisions of the Arbitral Tribunal would be appropriate.
