Abstract :
The 21st article of the Turkish Criminal Code states as a general rule that crimes can be committed wilfully. In terms of our Criminal Code the purpose of the perpetrator is insignificant for the occurence of the crime. However usually perpetrators do have a specific purpose and one of them is “joking”. This article analyzes acts performed as a joke within the scope of High Court decisions.
