The abuse of right prohibition is prescribed by the law as the sanction for the violation of rule of bona fides. As a general principle of law, rule of bona fides is applied not only in private law but procedure law even in public law. Considering the fact that foundation of prescription doesn’t aim to protect public order or public interest, theoretically there is possibility of implementing sanction of abuse of rights while debtor makes of prescription plea. But same sanction is not convenient for lapsings which are settled in order to protect public order or public interest.
