State Succession To Bilateral Agreements in Light of the 1978 Convention on Succession of States in Respect of Treaties: A Theoretical Assessment
Abstract :
The law of State Succession deals with the replacement of one State by another in the responsibility for the international relations of a territory. In this context, the issue of State Succession to treaties is one of the most controversial ones in modern international law. The 1978 Vienna Convention on Succession of States in Respect of Treaties, prepared by the International Law Commission, is the most comprehensive work on the subject. The Convention does not provide a unique framework for State Succession to all treaties, but foresees different rules for multilateral and bilateral treaties. While the provisions of the Convention concerning succession to multilateral treaties have been subject of numerous studies, internationalists have not paid sufficient attention to succession to bilateral treaties. In this context, this paper strives to analyze the principles provided under the 1978 Convention for State Succession on bilateral treaties.
