THE REFORM ACTIONS IN THE USA COMPETITIONLAW POLICIES
Abstract :
“Antitrust Modernization Commission” was established in 2002 with the “Antitrust Modernization Commission Act” for the purpose of accomplishing essantial reform in the American competition law system. Commission, in the sense of making a correct antitrust analysis especially in the sectors such as communication, information and telecominication which are arising in the new economy, made a detailed study on the reforms to be realised in the current USA competition law policy. Then, the Commission presented its opinion to the Congress as a report in 2007. This study examines the criticism and opinions about the report and the issues which are under debate in the report such as the importance of antitrust law in the new economy, enforcement institutions and exercise processes, civil damages actions about the breach of the antitrust law rules, exclusionary conducts, etc.
