WITHIN THE FRAMEWORK OF NATIONAL AND INTERNATIONAL REGULATIONS A CASE OF PSYCHOLOGICAL HARASSMENT IN THE WORKPLACE (MOBBING)
Abstract :
Working environment and organizational climate must be peaceful for human beings considering that they are social entities, in order to function efficiently and be successful. However, the high competition shows itself within the organization brought by globalization. A case of psychological harassment in the workplace reveals itself in business life getting difficult and highly competitive environment. Mobbing can also defined as psychological harassment in the workplace, has huge individual, organizational and social impacts. Being in the first place, the International Labour Organization and several countries have made arrangements including psychological harassment in the workplace. In our country, in the Turkish Code of Obligations, this issue have been addressed and imposed an obligation for employers to take necessary measures against psychological harassment in the workplace.In Turkish Labor Law although there is no direct regulation related to psychological harassment, there are some articles that protects workers. In this study, primarily psychological harassment in the workplace definition made to form conceptual framework. Afterwards, regulations that has been made in the international arena are included regarding this issue, finally, possible legal ways in the combat against psychological abuse in the establishment in our country are tried to be explained.
