Abstract :
The consciousness, which is special to human being and defined as ability to be aware of subjective and objective reality, is one of the essential concepts of psychology and philosophy. Besides, the consciousness has an important space in fiqh/law. This article aims to prove the importance of the consciousness in this field throughout its effect on the rights. In this context, firstly the concepts of right-oriented consciousness and right consciousness are defined, then their effects on the rights are examined. And finally, the effect of consciousness on the elements, acquirement, using, protecting and ending of rights, are illustrated with examples. It will be useful, if needed, in the next fiqh/law studies to deal with concept of consciousness and some aspects of it as like sleep, hypnosis etc. in this regard.
