  • Abstract
    The cost of litigating is going to increase dramatically and companies will need to start accounting for this and trade associations have already been warning about the likely rise in insurance premiums, particularly in the employer´s liability field. However, there are steps that companies can take. Firstly, they can conduct a ´healthcheck´ to make sure everything is in order and to make sure that contracts are being concluded on the basis of one´s standard terms and conditions of business. Healthchecks should be conducted not only in respect of contractual matters but could and should be extended to other areas such as employment matters and intellectual property.
