Abstract
Today, outsourcing can take various different forms. Application service provision (ASP) and data warehousing are two of the more ´in-vogue´ terms. On the other hand, facilities management and bureau services are less popular descriptions of outsourcing. In this paper, we identify and discuss 10 risks that are associated with the ongoing performance of the contract from a legal perspective. These are: transfer of assets; transfer of software licence; payments; limitation of liability; force majeure; termination; change control; continuity; foreign suppliers; data protection.
