Abstract
For the cases of private and state electrical energy distribution, it is always the last one that must realize, with its own resources, the investments of political and social character, such as public lighting and green spaces lighting, for example. The investments that each business realizes with the objective of improving the delivery of electrical energy service, in an effective and efficient manner, is the fundamental difference that defines the two systems. From this last point of view, if the state in its role as regulator imposes efficient controls that assure the strict compliance of the contractual obligations, and possess agile tools that achieve to adequately orient the investments of the private service distributors, not only on the technical side but also in other aspects such as commercial matters, surely it can guarantee that the users of electrical energy services can receive the service adapted to the tariff that they are paying, and the government can assure that the objectives of planning electricity that are defined in the private service contract are achieved
