Abstract
This paper studied how the power is contributed and operated during the formation of international IPR rules from a new perspective of politics analysis, for better domestic IPR legislation suggestions in China. It focused on agencies which make and enforce international IPR rules, and it also concentrated on the impetus and particular mechanism behind these agencies. Taking TRIPS agreement as an example, the author studied power distribution and operation among plural subjects at the national and international level by describing and analyzing the process of how it was made and enforced. Since making international IPR rules is a process of competition and negotiation, bargaining and interest balancing, China must learn how to use such rules to maximize own benefit.
