Abstract
This paper analyzed China¿s current legislation on intellectual property rights and the construction countermeasure, summed up the characteristics of patent strategy in the enterprises of Japan and the United States, base on this and propose that we take patent strategy as the foundation, to protect designing innovative of Chinese enterprises: Such as learn from Japanese experience, we may hold the advanced techniques through introduction of foreign technology, exploiting many small patents, build a external network of patents, foster our strengths and circumvent our weaknesses, value the role of patent intelligence. We should strengthen the exploitation and utilization of spare patents. Rather as America has done, we may connect our patents and intellectual property with foreign trade in order to control other countries¿ markets and keep our superiority in technological monopoly by adapting a series of policies and regulations.
