Abstract
This paper reviews the legal aspects of the EMC directive and aims to give manufacturers additional guidance as to how the directive might be interpreted by a court in UK. It is based on a study of both the directive and the UK implementing regulations and not legal case history. The paper covers the more important aspects of the UK legislation including the application of the directive, the apparatus to which it is applicable, CE marking requirements and the use of applicable standards. The Technical Construction File route is considered in some detail, with particular reference to the withdrawal of the technical report or certificate should a product be considered to be noncompliant. Finally, the declaration of conformity and other legal documentation and enforcement aspects are considered
