Abstract :
This paper employs a legislative perspective to analyze the status quo of public and private rights related to digital copyrights in EC. The extension of public rights has been placed more importance than private rights reservation. It shows that public rights are essential, but private rights are more urgent to rescue. It is thus concluded that the desired legislation of copyrights is like this: private rights lead public rights, with assistance of IT and nonlegal institutional innovations
