Abstract :
While the fast development of third party payment market is boosting China\´s e-commerce, the nature and disposal of interest accrued from precipitation capital has drawn hot debate. In November 2011, People\´s Bank of China promulgated Interim Measures on the Depository of Excess Reserves of Payment Institutions(Draft)", " which stipulated that 90% of interest accrued from precipitation capital be given to third party payment institutions. By studying the Interim Measures (Draft), this article, based on analysis of U.S. related legislations of third party payment precipitation capital and business practices, discusses the nature and ownership of precipitation capital under third party payment. This article also does some research on disposal methods of interest accrued from precipitation capital under third party payment on the basis of disposal principle, disposal entity and disposal route.
