Abstract :
Antitrust legal risk of patent pool has important significance in theory and practice. This article applies mathematical statistics method and structural equation modeling to investigate patent pools in U.S., Europe, and China. This empirical research demonstrates that certain forms of constitution of patent pool generate positive impact on the outcome of antitrust legal risk against patent pool; certain restrictive licensing activities of patent pool generate positive impact on the occurrence of antitrust legal risk against patent pool.
