After careful and considered review of the content of this paper by a duly constituted expert committee, this paper has been found to be in violation of IEEE´s Publication Principles.
We hereby retract the content of this paper. Reasonable effort should be made to remove all past references to this paper.

The paper tries to explore the internal logic in the historical development of urban planning law system by using two different analysis theories and thoughts of the representative figures Friedrich Hayek and Douglas North in the economic analysis of system for reference. After a historical review on the three main stages, the author holds that the institutional development of laws and regulations for urban planning in China is a process of combination and transmutation of rational evolution and institutional change, and puts forward thoughts on the progressive development of the balance model of urban planning law system innovation.
