Once the decision to file a patent application has been made, a number of important strategic considerations are necessary to guarantee that a commercially valuable patent will eventually be granted. This decision-making process, beginning with the formulation of an appropriate claim strategy for the US application and continuing through the choice of foreign countries for foreign prosecution, is vital to the success of a patent application both in the Patent and Trademark Office and, eventually, in the marketplace
