Abstract :
The Supreme Court of Cassation of Italy has recently recognized the occupational origin of a trigeminal schowannoma in a heavy user of mobile telephones. We describe and discuss the salient aspects of this unprecedented ruling as a case-study in the framework of the use (and misuse) of scientific evidences in toxic-tort litigation. The WHO (World Health Organization) has classified mobile phone radiation on the IARC (International Agency for Research on Cancer) scale into Group 2B - possibly carcinogenic to humans on May 31, 2011. "Could be some risk" of carcinogenicity, so additional research into the long-term, heavy use of mobile phones needs to be conducted.
