Abstract :
While the U.S. Courts, Patent and Copyrights offices work in defining what consist of elements of crime that could be legislated against music piracy, it may be necessary to share some of the factors often considered by the courts in prosecuting those accused of music piracy violation. This paper focused in sharing with the scientific communities the independent variables used in legal prosecution and proposed further research in support or disprove of these variables. Those who make the law must understand what they are protecting against, such that the law should not exist in the vacuum of its remedy. To review the factors affecting music piracy from the eyes of the law should benefit the judicial system.
