تاملي بر حقوق و تكاليف زوج مسلمان و زوجه ي كافر در زندگي زناشويي

A Reflection on rights and assignments Muslim and non-Muslim Spouses in the wedded life

يكي از مباحث مهم در حوزه ي فقه خانواده، ازدواج زن و مردي است كه دين مشترك ندارند. صرف نظر از بحث مهم و اختلافي صحت يا بطلان ازدواج مرد مسلمان با زن غيرمسلمان اين سوال مطرح مي شود كه چنانچه همسر مرد مسلمان، زن غيرمسلمان باشد، آيا تمامي حقوق و تكاليفي كه زوجه ي مسلمان دارد، زوجه ي غيرمسلمان نيز دارد؟ تحقيق حاضر، با بررسي مهم ترين حقوق و تكاليف زوجه ي مسلمان و غيرمسلمان به اين نتيجه مي رسد كه نه تنها در مواردي نسبت به زوجه ي نامسلمان تساهل و آسان گيري بيشتري شده - آنجا كه او را به پذيرش اصل دين مجبور نمي كند- بلكه وي را به رعايت احكام و دستورات اسلام كه فرع بر پذيرش اسلام است مانند حجاب، غسل جنابت و... نيز مجبور نمي كند؛ هر چند اميد است، وي به دين اسلام ترغيب و تشويق شود. همچنين بنا بر اطلاق ادله، همان حقوقي كه زن مسلمان نسبت به شوهر خود دارد، از قبيل مهريه، حق سُكني، حق طلاق، حسن معاشرت و... زن غيرمسلمان نيز نسبت به شوهر خود دارد و تنها ارث بردن زن كافر از مرد مسلمان استثناء شده است.

One of the major issues in the field of Family Jurisprudence، is the Marriage of a man and a woman who do not share a common religion. Regardless of the important controversial is sue of the appropriacy of marriage of a Muslim man to a non-muslim woman، the following question is raised: is the non-muslim wife entitled to equal rights and duties as a muslim wife when the muslims wife is a non- muslim? Investigating the most importand the rights and duties of muslim and non-muslim wires، the present research concludes that in many cases there is more Tolerance and Leniency towards a non-muslim wife. A non-muslim wife does not have to accept the principle of religion.Also، she is not obliged to observe the laws and directives of Islam which are subordinat to acceptance of Islam including wearing veil and performing ablution after sexuat intercourse of course، it is hofed that she will be encouraged to convert in to Islam. Also، according to generic reasons، a non-muslim wife is entitled to the same rights as a muslim wife including dowry، residence right، divorce، vow right and good relationship.The only exception is inheritance of aethist wife from her husband.
