Orders Subjection to Benefits and Corruptions

هدف: آيا همة احكام تابع مصالح و مفاسد واقعي اند؟ با وجود اعتقاد مشهور عدليه به تبعيت احكام از مصالح و آن است، اختلاف وجود دارد؛ مشهور عدليه بر اين » متعلق « يا در » نفس جعل احكام « مفاسد، در اينكه آيا مصلحت در باورند كه همة احكام، تابع مصالح و مفاسد واقعي اند و مصلحت در متعلق احكام است. در مقابل، برخي بر اين باورند همانطور كه بخشي از احكام تابع مصلحت واقعي و مصلحت درمتعلق احكام است، برخي ديگر از احكام نيز مصلحت در نفس تشريع است. هدف مقاله، اثبات تبعيت همة احكام ازمصالح و مفاسد واقعي است. روش: اسنادي و تحليلي با تكيه بر متون كلامي، فقهي، اصولي، قرآن و روايات است. يافته ها: با اينكه تبعيت احكام از مصالح و مفاسد در نظر اماميه امري قطعي و مسلّم است، با اين حال، قاعدۀ مذكور از ديرباز محل بحث بوده است. با تأمل معلوم مي شود در موضوع تبعيت احكام از مصالح و مفاسد چهار قول وجود دارد: نفي تبعيت(اشاعره) ، پذيرش تبعيت مطلق(مشهور عدليه)، پذيرش تبعيت نسبي، نفي تبعيت ضمن نفي مباني اشاعره. نتيجه گيري: با بررسي اقوال، ادلّه و نقد آنها، اصح اقوال كه تبعيت مطلق احكام از مصالح و مفاسد واقعي است به اثبات ميرسد.

Objectives: The aim of this research is to clarify whether all orders are subject to actual benefits and corruptions or not? The justice believer's (Celebrity Justice) well known idea is in Orders subjection to benefits and corruptions. On the other hand there is differentiation in opinions that whether benefit is in making just the orders or in bounded of orders. The justice believer's well known idea is that the Orders are subject to benefits and corruptions and benefit is in making the bounded of orders. Celebrity Justice believes that all orders are subject to real interests and corruptions, and benefit is owned in the sentences .In contrast, some believe, as part of the rules is in the function of real interest, and benefit is owned in the sentences, and also some of the provisions of the legislation are deemed breath. This paper aims at proving all the provisions and real corruption. Method: The method of the present research is Documentary and analytical and on the basis of theological texts, jurisprudence, principles, Quran and traditions. Results: Although commandment adherence of the corruptions is apparent from Shiite Muslim affairs, the rule has long been debated. Reflecting becomes clear that on the issue of commandment adherence of the corruptions there are four words: Denial of citizenship (Ash'ari), accepting absolute subordination (Celebrity Justice), accepting partial compliance, following the rejection of denying the foundations of Ash'arite. Conclusion: The authors of the present survey conclude by studying the opinions, arguments and opinions, subordination is an absolute adherence to the real provisions.
