بررسي منشاء انسان شناختي حقوق فرهنگي بشر

Study of Anthropological Origins of Human Cultural Rights

مقدمه اعلاميه جهاني حقوق بشر، «شناسايي حيثيت ذاتي» كليه اعضاي بشري را به عنوان اساس آزادي، عدالت و صلح در جهان شناخته و بر باورداشتن به «مقام و ارزش فرد انساني» توسط مردم ملل متحد و اين كه «حقوق انساني» را بايد با اجراي قانون حمايت كرد، تاكيد شده است. اما وضع و اجراي قانون و اصولا بنيادي­ترين جستار در دانش­هاي انساني و از جمله در حقوق، فرع بر شناخت «انسان» مي‌باشد. حقوق فرهنگي بشر نيز از اين قاعده مستثني نيست. اين پژوهش با طرح اين سئوال كه «مباني انسان­شناختي حقوق فرهنگي بشر چيست؟» به روش تحليل كيفي محتوا با نگرشي انسان شناسانه به ارزيابي اين فرضيه مي‌پردازد كه «حقوق فرهنگي بشر ريشه در طبيعت انسان و ساختمان بدن او دارد». يافته ها دلالت بر آن دارد كه مطالعه و بررسي تعريف، پيدايش، ساختمان بدن و آناتومي و شيوه­ي زيست انسان و رابطه اي كه با فرهنگ دارد نشان دهنده­ي اين است كه انسان موجودي است فرهنگي و حقوق فرهنگي خاستگاهي در طبيعت انسان داشته و براي حمايت و ارتقاي حقوق فرهنگي بشر، بايد بر تطابق اين حقوق با منشاء انسان­شناختي آن تاكيد ورزيد.

In the introduction of the Universal Declaration of Human Rights, “recognition of inherent dignity” of all human members is realized as the basis of freedom, justice, and peace around the world and it has been emphasized on believing in “dignity and value of individual human” by the people of the united nations and also the fact that “human rights” must be supported by law enforcement. However, legislation and enforcement of law and principally the most basic inquiry about humanistic sciences including law have a secondary status in relation to recognition of “human”. Therefore, there is no exceptions to human cultural rights in regard to this principle, too. By posing this question that “what are the anthropological principles of human cultural rights”, and applying a qualitative content analysis with an anthropological approach, the present study is an attempt to evaluate this assumption that “human cultural rights are rooted in human nature and his physique”. The results indicated that studying definition, origin, physique, anatomy and lifestyle of human and his relationship with culture imply that human is a cultural creature and cultural rights have their origin in human nature; accordingly, to support and promote human cultural right, we need to put emphasis on compliance of these rights with their anthropological origin.
