مسووليت مدني دولت: برآيند تقابل دولت و جامعه مدني

STATE LIABILITY: THE OUTCOME OF CONFRONTATION BETWEEN STATE and CIVIL SOCIETY

ين مقاله سعي در اثبات اين فرض دارد كه رابطه ميان نقش دولت در اجتماع سياسي و مسووليت مدني اين نهاد، رابطه اي معكوس است. به بيان ديگر، گسترش نقش دولت در جامعه و امكان مداخله بيشتر آن در اجتماع سياسي با كم رنگ شدن مسووليت و به تبع آن مسووليت مدني اين نهاد ملازمه دارد و در مقابل تحديد اين نقش موجب فزوني مسووليت و در پي آن، مسووليت مدني دولت مي شود. در اين مقاله حقوق كشورهاي كانادا و فرانسه و نيز ايالت كبك كانادا به عنوان شاهد مدعا در زمينه بحث مورد بررسي قرار گرفته اند. اين مقاله سعي در اثبات اين فرض دارد كه رابطه ميان نقش دولت در اجتماع سياسي و مسووليت مدني اين نهاد، رابطه اي معكوس است.

The present article tries to prove that there is a reverse relation between the role of state in political society and its liability. In other words, the greater state’s interference with the political society, the less will be its responsibility and hence its liability. On contrary, making limitation to the state’s role in political society will increase its responsibility and thus its liability. French and Canadian legal system, as well as Quebec provision legal system, are discussed and studied to provide evidence in this regard. The present article tries to prove that there is a reverse relation between the role of state in political society and its liability. In other words, the greater state’s interference with the political society, the less will be its responsibility and hence its liability.
