Comparative Method in the Medical Ethics Methodology in Islam

چكيده مقدمه: متدولوژي اخلاق پزشكي، در كنار تبيين روش استخراج و استنباط احكام و مسائل مطرح در حوزه اخلاق پزشكي، به دو موضوع ديگر نيز مي‌پردازد: 1- روش استفاده از چارچوب اخلاق پزشكي در پياده سازي و انطباق آن بر موارد مبتلابه 2- ارائه وظيفه عملي به هنگام نبود قانون يا حكم مورد اين دو بخش مهم از متدولوژي در مقاله حاضر مورد واكاوي و تحقيق قرار گرفته است. مواد و روش تحقيق: اين پژوهش به صورت كتابخانه‌اي، توصيفي و تحليلي صورت پذيرفته است. پس از تبيين اصل مسأله، سعي شده كه روش تصميم‌سازي اخلاقي براي شاغلين در كلينيك تبيين و ارائه شود. يافته‌ها: قانون و حكم فقهي مهمترين مرجع تصميم‌گيري اخلاقي در نظام اخلاق پزشكي اسلام هستند. در صورت شك در قانون يا حكم موردي لازم است علت ايجاد شك بررسي و دقت شود تا حتي الامكان شك برطرف شود. در صورتي كه نتوان قانون يا حكمي را مستمسك تصميم خود قرار داد، سعي مي‌شود به كمك قواعد اخلاق پزشكي مسير تصميم‌گيري را پيش برد. نتايج: مراجع تصميم‌گيري اخلاق پزشكي در اسلام، به ترتيب اولويت عبارتند از: • قانون • حكم فقيه داراي شرايط • قواعد فقهي ناظر بر اخلاق پزشكي

ABSTRACT Introduction: Medical ethics methodology, beside the explanation of extraction and verdict inference methods and considered problems in medical ethics, proceeds two other subjects: 1- Using method from medical ethics framework to establish and to conform it to the affected cases. 2- Presentation practical duty at the time of law or verdict case absence. These two important parts of methodology will be studied and analyzed in the present article. Materials and Methods: This is a library, descriptive and analytical study. The efforts have been conducted to explain and provide moral decision making method for the personnel in clinics. Findings: Law and religious precepts are the most important references for moral decision making in medical ethics. Doubting in the law or verdict of any case evaluation and exactness seem necessary to remove doubt as much as possible. If one could not pretense any law or verdict for his (her) decision, the efforts should be conducted to improve the way of decision making by the help of medical ethics rules. Results: The priority references of medical ethics decision making in Islam are as follows: • Law • Qualified jurisprudent verdict • Religious jurisprudence rules supervising on the medical ethics.
