چكيده فارسي :
زمينه و هدف: يكي از مشكلات يا معضلاتي كه مأموران پليس با آن دست به گريبان هستند مشكلات ناشي از به كارگيري سلاح گرم در مأموريت‌هاي پليسي است به نحوي كه سالانه عده‌اي از مردم و متهمان در نتيجه استفاده افسران پليس از سلاح كشنده دچار مرگ، آسيب جدي و دچار ضرر و زيان مالي و جاني مي‌شوند. در اين پژوهش، محقق به دنبال ارائه راهكارهاي مناسب براي استفاده از سلاح غيركشنده در تعقيب متهمان و پايين آمدن آمار تلفات ناشي از تيراندازي پليسي است.
روش‌شناسي: تحقيق از لحاظ هدف كاربردي است و از لحاظ ماهيت توصيفي- تحليلي است يعني ضمن توصيف وضع موجود با استدلال عقلاني و قياسي به محاسن و معايب وضع موجود پرداخته و قواعد حقوقي بهتر و كاراتري را در اين حوزه پيشنهاد مي‌دهد.
يافته‌ها: با بررسي و تحقيق به عمل آمده بكارگيري سلاح‌هاي غيركشنده نسبت به سلاح‌هاي كشنده نقش مؤثري در كاهش پيشامدهاي اجتماعي و سازماني ناجا دارد كه در اين راستا راهكارهايي شناسايي و پيشنهاد گرديد. نتيجه‌گيري: استفاده از سلاح غيركشنده نقش حساسي بر اجتماع و سازمان پليس دارد. اولين اثر آن كاهش تلفات انساني است كه با توجه به آيات قرآن، احاديث و منابع فقهي حفظ جان انسان و احتياط در دماء يكي از مهم‌ترين اثرات استفاده از سلاح غيركشنده است. دومين اثر آن با توجه به ماهيت سلاح كه كشنده نيست، سبب افزايش جامعه محوري پليس از منظر مردم مي‌گردد كه خود اين امر سبب بالا رفتن رضايت از سازمان شده و در ضمن سبب كاهش هزينه‌هاي پرداخت ديه نيز مي‌شود كه خود اين امر سبب حفظ بودجه سازمان و صرف تعالي سازماني مي‌گردد. سومين اثر آن با توجه به كاهش قتل و صدمه جسماني در حوزه مأموريت‌هاي پليس، اين امر سبب كاهش شكايات از كاركنان و عدم سلب انگيزه از مأموران مي‌گردد كه خود اين امر نقش بسزايي در پويايي سازمان دارد.

Background and objectives: One of the problems that police officers are facing is the problem caused by the use of firearms in police missions, so that annually, some people and defendants suffer from death, serious harm, financial and life losses as a result of the use of police officers from a deadly weapon. As a result, a large number of police officers and police officers have been tried in military courts for committing murders or physical injuries due to the use of weapons, and in some cases have been personally sentenced to payment of money, imprisonment or, in some cases, retaliation, and in other cases, the police have paid Diyah. In this research, the researcher is seeking to provide appropriate strategies for using non-lethal weapons when chasing the suspects and lower the number of casualties caused by police shooting. Methodology: In terms of its purpose this study is of an applied research type and in terms of its nature it is considered as descriptive-analytic study. It describes the existing situation and addresses the merits and demerits of the present situation through rational and deductive reasoning and proposes better and more efficient legal rules in this area. Findings and results:The use of non-lethal weapons plays a critical role in the community and police organization. Its first effect is to reduce human casualties; according to Quranic verses, hadiths and jurisprudential sources, preserving human life and precaution is one of the most important effects of the use of non-lethal weapons. Second, due to the nature of the weapon that is not deadly, it increases the community-basis of police from the perspective of the people, which itself increases the satisfaction with the organization and government and also reduces the cost of paying Diyah, which itself preserves organization budget and organizational excellence. The third effect, due to the decrease in the number of murders and physical damage in the field of police missions, it reduces the number of complaints from employees and the lack of motivation from the agents, which itself has a significant role in the dynamics of the organization
