تبيين نقش پليس ترميمي در شرمساري پيشگيرانه از تكرار جرم

زمينه و هدف: يكي از مشكلات جوامع امروزي افزايش پديده بزهكاري و تكرار آن مي‌باشد. يكي از سازمان‌هاي مهم در زمينه مبارزه با بزهكاري، سازمان پليس است. پليس به دليل برخورد اوليه با بزهكاران در زمينه پيشگيري از تكرار بزهكاري مي‌تواند نقش بسزايي ايفا كند. يكي از اقدامات پليس در اين راستا، استفاده از برنامه پليس ترميمي است. پليس ترميمي برنامه‌اي است كه در اختيار پليس جامعه‌محور قرار مي‌گيرد تا از طريق عملكرد خاص خود، بتواند به پيشگيري از تكرار جرايم بپردازد. لذا با توجه به اين كه پژوهش‌هايي در مورد پليس جامعه‌محور انجام گرفته اما پژوهشي در زمينه پليس ترميمي صورت نگرفته در اين پژوهش به اين موضوع پرداخته شده است. روش‌شناسي: اين پژوهش از نظر هدف، كاربردي و از نظر شيوه اجرا توصيفي-تحليلي است. داده‌ها به شيوه اسنادي و كتابخانه‌اي از كتاب‌ها، مقاله‌ها و ترجمه‌ها استخراج و مورد تجزيه و تحليل قرار گرفته است. يافته‌ها و نتايج: نتايج حاصل از تحقيق نشان مي‌دهد كه پليس سنتي با اقدامات سركوب‌گرانه خود در تأمين هدف مبارزه با جرايم موفق عمل نكرده است. بدين معنا كه اقدامات انجام گرفته توسط پليس و سيستم رسمي رسيدگي، برچسب مجرمانه‌اي به بزهكار الصاق مي‌كند كه اصلاح و بازگشت وي به جامعه را با مشكل روبه‌رو مي‌كند در نتيجه، اين امر منجر به تكرار جرايم مي‌گردد. در حالي كه پليس، در رويكرد جديد جامعه‌محوري خود از مشاركت مردم در تأمين نظم و امنيت و مبارزه با جرايم استفاده مي‌كند. در اين راستا برنامه جديدي به نام پليس ترميمي به پليس جامعه‌محور ارائه مي‌شود در اين برنامه پليس با استفاده از روش‌هاي ترميمي مانند ميانجيگري و نشست و با مشاركت جامعه، بزهكار و بزه‌ديده را در كنار هم قرار مي‌دهد تا از طريق مسئوليت‌پذيري و ايجاد شرمساري بازپذيركننده در بزهكار از تكرار جرايم پيشگيري كند.

Background and objectives: One of the problems of today's societies is an increase in the phenomenon of delinquency and crime repetition. One of the key organizations in the fight against crime is the police organization. Police can play a significant role in preventing crime repetition due to the initial dealings with criminals. One of the police actions in this regard is the use of a restorative policing program. The restorative policing is a program that is being made available to the community policing to help them prevent crime repetition through their own specific functions. Therefore, considering that some studies on community policing have been carried out, and no research has been conducted on restorative policing, this study has addressed this issue.
Methodology: In terms of its objectives this study is of an applied research type and in terms of methodology it is a descriptive-analytical study. The data were collected and extracted from books, articles and translations using a documentary method and library study and then analyzed.
Findings and Results: The results of the research show that the traditional policing have not succeeded in fighting against crimes through its repressive measures. In this sense, the police and the official investigation system attach the label of a criminal offender to the criminals that makes the offender's correction and return to the society difficulty. As a result, this leads to crime repetition. While the police, in their new community-based approach, use people's participation in order and security and fighting against crime. In this regard, a new program called a restorative policing is provided to the community policing. In this program, the police gather the delinquent and the victim together to prevent crime repetition by means of restoration methods, such as mediation and social gatherings, and bringing responsibility and creating a retributive shame in the offender.
