Challenges of Applying General Rules of Punishment to Legal Entities

اعمال قواعد عمومى مجازات نسبت به اشخاص حقوقى با چالش هايى همراه است. قواعد عمومى مجازات شامل قواعد مربوط به شرايط و موانع مسؤوليت كيفرى و قواعد مربوط به تعيين نوع و ميزان و نحوه ى اعمال مجازات است. پرسش اين است كه آيا در اعمال قواعد عمومى مجازات نسبت به اشخاص حقوقى، شخصيت شخص حقوقى ملاك خواهد بود يا شخصيت شخص حقيقى كه نماينده ى شخص حقوقى محسوب مى شود. هم چنين چگونگى اعمال موانع مسؤوليت كيفرى و قواعد عمومى تغيير دهنده ى مجازات ها نسبت به شخص حقوقى با ابهام مواجه است. نتيجه ى اين نوشتار آن است كه، با توجه به ماهيت اعتبارى و تبعى اشخاص حقوقى، رفتار مجرمانه ى منتسب به شخص حقوقى توسط نماينده ى آن انجام مى شود و لذا در اعمال قواعد عمومى مجازات شخصيت نماينده بايد مورد توجه قرار گيرد. هم چنين قواعدى كه معيارهاى اعمال آن ها نوعى است و مرتبط با شخصيت مرتكب جرم نمى باشد، در خصوص اشخاص حقوقى اعمال خواهد شد.

The general rules of punishment can be divided into two categories: "Rules on the conditions and barriers of criminal responsibility" and "Rules for determining (type and amount) of punishment. The main question that arises is that the criterion of practice in the application of general rules to punish will be the character of a legal entity or person that is representative of the legal person. Barriers to criminal responsibility and the rules that change criminal liability how apply to the legal entities? Due to the virtual and subordinate nature of the legal entities the criminal conduct is attributable to the representative of the legal entities, so the representative of the legal entities will be considered in the applying of the general rules of punishment.
