چكيده فارسي :
تحقيق حاضر به بررسي چگونگي پرداخت فاضل ديه از طرف خانواده زن مقتول به قاتل در انجام قصاص پرداخته و با استفاده از منابع كتابخانه‌اي و روش تحقيق توصيفي و تحليل نظر فقيهان ، بيان داشته كه قتل چه از طرف مرد و چه از طرف زن واقع شده باشد،در درجه اول حكم يراي هر يك از ايشان قصاص است. و با توجه به نظر برخي فقها نسبت به تفاوت عدم پرداخت فاضل ديه از طرف خانواده‌هاي فقير و غير فقير ،توجه قانونگذار را به اصلاح و تغيير شكلي قانون فعلي معطوف مي‌دارد.اما نكته قابل اهميت اينكه سياست جنايي با رويكرد جديدي كه دارد تدوين قانون را، به عنوان سياست جنايي تقنيني، تنها يكي از ابزار مي‌داند لكن ابزارهاي ديگري چون عملكرد مقامات اجرايي و قضايي و در مواردي با اجازه شرع و قانون، مشاركتهاي مردمي تاحدود قابل توجهي مي‌تواند اشكالات موجود را مرتفع سازد. مطابق آيات شريفه قرآن در موضوع فعلي توصيه به عفو و گذشت و همياري و همدلي مردم نسبت به يكديگر، يادآور سياست جنايي قضايي و مشاركتي است كه مقامات قضايي مي‌توانند در اين زمينه قدمهاي موثري بردارند و درصورت تصميم خانواده‌ها به اجراي قصاص، براي احقاق حق خانواده فقير تلاش نمايند.

The article is done through library research and descriptive method along with analyzing the ideas of jurists who state that in the case of murder, whether the slain is man or woman, the primary code is retaliation, and paying half of the blood money is not considered. By the acceptance of the scholars ` view point regarding not paying the half of the blood money by those poor families who cannot afford it, the legislator came to conclusion to change and reform the current article. The important point here is that the criminal policy with the new approach, considers the legislation, as legislative criminal policy, just as a tool. Rather it considers the other tools such as performance of the administrative and juridical authorities, and in some case with the permission of Shri`ah and law, the contribution of people, to the considerable extant, may solve the problem. According to the verse of the holy Quran regarding the current issue, advising and encouraging people to forgiveness, helping one another, and having the feeling of sympathy towards each other, the cooperative criminal policy and helping the poor families to apply retaliation by giving them time in order to pay half of the blood money with the support of juridical and administrative authorities and also holding meetings by the administrative authorities for reconciliation and compromise between two sides, as the juridical-criminal policy, would be helpful.
