تحليل پديده حيوان آزاري در فقه اماميه و حقوق ايران

يكي از مظاهر خلقت خداوند متعال كه نقشي مهم و درخور توجه در نظام طبيعت و زندگي بشري دارد حيوان مي باشد. فرموده خداوند متعال است كه به پاس نعمت هاي ارزاني داشته او را شكرگذار بود نه ناسپاس. از جمله نعماتي كه براي انسانها قرار داده آن است كه وي را اشرف مخلوقات آفريده و آنچه در آسمانها و زمين وجود دارد به تسخيرش درآورده است. شايسته اشرف مخلوقات نيست كه ناسپاسي كند و از قدرتي كه خداوند به او وديعه داده ، استفاده نابجا نمايد. اما در عصر حاضر همگام با تحولات همه‌ جانبه در زمينه‌ هاي علمي و فناوري و... سوء استفاده از محيط زيست و حيوانات سرعت چشمگيري داشته است. از جمله نمونه هاي اين استفاده نابه جا پديده حيوان آزاري مي باشد. لذا بعد از بررسي مباني اوليه و جايگاه حقوق حيوانات در شرع مقدس اسلام و همچنين قوانين داخلي كشور، به اين سوالات پاسخ داده خواهد شد كه اولا حكم حيوان آزاري از منظر شرعي چيست؟ ثانيا آيا در قانون داخلي پديده حيوان آزاري جرم انگاري شده است؟ در پاسخ مي توان گفت از نگاه شرعي، اين پديده مورد نهي قرار گرفته و مشمول حكم حرمت مي شود اما در حقوق داخلي ايران براي پديده حيوان آزاري جرم انگاري لازم كه بتواند بازدارنده واقع گردد، صورت نگرفته است.

One of the manifestations of great God’s creation is animal that have important and sighnificat role in nature and human life. It is compassionate God ordered that for the blessing has given should be grateful not ungrateful. Among the gifts were for mens is that he is the best creature created and whatever in the heavens and the earth brought him to conquer. Ingratitude isn’t worthy of the best creature and should not abuse the power given to him. Keep pace with global changes in science and technology and etc. Misuse of the environment and animals was speed considerably.one of the example of this abuse is animal abuse. So after checking the basic principles and position of the animal rights in Islam and also domestic law, these questions will be answered: First what is the rolling religious point of view animal abuse? Second did animal abuse have been criminalized in domwstic law? It could said in response: This phenomenon in religious point of view was forbidden and is forbidden. But it wasn’t iran’s domestic law to criminalized this phenomenon could be deterrent.
