Rational Elements and Components of Understanding the Legal Differences of Men and Women in Islam

كنار زدن عناصر رهزن و منحرف‌كننده از يك‌سو و بررسي مؤلفه‌هاي دخيل در فهم صحيح تفاوت‌هاي حقوقي زن و مرد نقش به‌سزايي در فهم درست فلسفه تفاوت‌ها و پاسخ به منتقدها دارد. عناصر رهزن كه در مقاله پيش‌رو بررسي شده عبارت هستند از: پيش‌فرض‌هاي اشتباه، جهل به تفاصيل احكام، عدم آشنايي با علم تفسير، نگاه تاريخ‌مند به دين يا آموزه‌هاي آن و نيز تصور اصلاح‌پذيري دين به‌دست بشر، ابتدا بايد اين عناصر كه مانند عينكي ديد منتقدان را تحت تأثير قرار داده زدوده شود و در مرحله بعد با بررسي مؤلفه‌هاي دخيل در فهم صحيح تفاوت‌هاي حقوقي زن و مرد نگاه صحيح و واقع‌گرايانه‌اي در اختيار قرار داد؛ لحاظ ويژگي‌هاي ذاتي زن و مرد در نظام حقوقي اسلام، توجه به حكمتِ عدالت‌محور الاهي در اين تفاوت‌ها، توجه به اين‌كه اصل و قاعده در تشريع، شموليت آن نسبت به تمام زمان‌ها و مكان‌ها و شرايط است، دقت در پافشاري‌هاي اسلام بر اجتماع سالم و پاك و سرانجام نگاه به نتيجه تجربه سختي كه بشر در طول تاريخ پشت سر گذارده و سرنوشت تلخ زنان غرب در نتيجه دوري از نظام حقوقي الاهي، از مؤلفه‌هايي هستند كه توجه به آن‌ها مي‌تواند فهم صحيح و منصفانه‌اي از تفاوت‌هاي حقوقي زن و مرد در اسلام به‌دست دهد.

The removal of rational and distorted elements on the one hand and the examination of the components involved in the correct understanding of the legal differences between men and women play a significant role in understanding the philosophy of differences and in responding to critics.
