مسئوليت بين‌المللي ايكائو در اجراي سامانه‌هاي ماهواره‌اي هدايت هواپيما

International responsibility of ICAO in utilization of Satellite Navigation Systems

پيشرفت فناوري‌هاي جديد و روند روبه‌رشد آن در سال‌هاي پاياني قرن بيستم، زمينه‌ساز طرح موضوع استفاده از ماهواره‌ها در هدايت هواپيماها گرديد. علي‌رغم اينكه ابعاد فني پروژه مذكور تاكنون پيشرفت قابل ‌توجهي داشته است، مسائل حقوقي و سياسي آن همچنان در مرحله بررسي كشورها و نهادهاي بين‌المللي مرتبط با صنعت هوانوردي قرار داشته و تاكنون منجر به تصميم‌گيري نهايي نشده است. از آنجا كه ايكائو از سازمان‌هاي مهم بين‌المللي فعال در صنعت هواپيمايي مي‌باشد، اين سؤال مطرح مي‌شود كه سازمان مذكور در اجرايي‌ساختن سامانه‌هاي ماهواره‌اي هدايت هواپيما و رفع ابهامات موجود در اين حوزه، چه نقشي مي‌تواند ايفا كند. بررسي اسناد و كنوانسيون‌هاي بين‌المللي در حقوق هوافضا، اين فرضيه را به دست مي‌دهد كه ايكائو مي‌تواند در ابعاد مختلفي از جمله تصويب و اصلاح استانداردها و رويه‌هاي پيشنهادي، تشريك مساعي و همكاري‌هاي فني، تلاش به‌منظور دستيابي به يك سامانه جديد، ايجاد يك چهارچوب حقوقي مناسب و نيز صدور تأييديه و اعطاي مجوز به ارائه‌دهندگان خدمات ناوبري ماهواره‌اي نقش مؤثري داشته باشد.

Development of new technologies and its growing process in the last years of the twentieth century, leads to the use of satellites in navigation. Although the technical aspects of this project has significantly improved, legal and political aspects of it, have been subject of different views of states and of international organizations related to aviation industry and though have not led to a final decision. Since ICAO has been an important and active international organization in aviation industry, the question is that what a role it can play in various aspects of the implementation of satellite systems and overcoming the challenges in the field. An overview of international instruments in the field of aerospace law shows that ICAO can play an effective role in adoption and amendment of the recommended standards and practices, collaboration and technical cooperation, efforts to achieve a new system, the creation of an appropriate legal framework and the according verification and authorization of to the satellite navigation service providers.
