مسئوليت دولت در قبال حقوق مالكيت فكري و امنيت غذايي شهروندان

State`s Responsibility for Protecting the IPRs and the Food Security of Citizens

حمايت از حقوق مالكيت فكري در حوزۀ كشاورزي و دانش‌هاي مرتبط، به صورت مستقيم و غيرمستقيم آثاري بر امنيت غذايي دارد. حق غذا و حق مالكيت فكري هر دو در اسناد حقوق بشري شناسايي شده اند و تكليف بر حمايت و تامين اين حقوق بر عهده دولت به عنوان حافظ منفعت عمومي قرار دارد. نوع و ميزان تأثير و نيز تزاحم يا سازگاري اين دو مقولۀ حقوقي، مورد مناقشه بوده و بر اهميت و دشواري مسئوليت دولت در برقراري و حفظ تناسب لازم در اين باب اين افزوده است. به نظر مي‌رسد نيل به نقطه تعادل جهت تأمين و حفظ تناسب لازم ميان دو مقوله امنيت غذايي و حقوق مالكيت فكري، نيازمند اتخاذ تدابير و استقرار نظام پيچيده‌اي از حقوق مالكيت فكري است كه بتواند به صورت مؤثري از حقوق فعالان ضعيف‌تر مانند كشاورزان و دارندگان دانش سنتي حمايت كند. در اين راستا اصلاح و تدوين قوانين كارآمد در حوزه حقوق مالكيت فكري تنها در صورتي به نفع عموم افراد جامعه خواهد بود كه همگام و همسو با ساير قوانين و سياست‌ها از جمله تامين امنيت غذايي باشد.

The protection of IPRs in agriculture and its related areas affects food security directly and indirectly. Right to Food and IPRs has both recognized in human rights instruments and states have the duty to protect and provide these rights. However the approaches about the relationship between IPRs and food security have been inconsistent so far. This inconsistency about the interaction between these areas of law-i.e. their conflict or their co-existence has made it difficult for governments to keep balance between them. It seems that keeping balance between IPRs and food security requires the establishment of a complex system which can effectively protect the weaker actors such as farmers and traditional knowledge holders. In this respect codification of effective rules about IPRs will be appropriate to public interests only if coexists with other rules and policies such as providing food security.
