تأثير عدالت در توسعه اجتماعي _ فرهنگي با تأكيد بر فقه و حقوق موضوعه

Place of justice in cultural- social development with emphasis on Positive law

امروزه عدالت و جايگاه آن، به عنوان مؤلفه‌اي مهم در تحقق توسعه اجتماعي، مورد توجه نظريه‌پردازان توسعه‌انديش قرار گرفته است. حقوق موضوعه در ايران پس از انقلاب به مثابۀ پشتوانه‌اي است كه از خلال آن بتوان تحقق «عدالت» در امور مختلف جامعه را مورد صيانت قرار داد؛ لذا در اين پژوهش به بررسي جايگاه عدالت در توسعه اجتماعي با تأكيد بر حقوق موضوعه پرداخته‌ايم. سئوال اصلي در آن است كه جايگاه عدالت به معناي إعطاء كل ذي حقٍ حقٌهٌ (دادن حق به هر صاحب حقي) در توسعه اجتماعي-فرهنگي كجاست؟ مقاله با كاربست روش توصيفي-تحليلي در صدد است با تكيه بر حقوق موضوعه جايگاه عدالت در توسعه اجتماعي-فرهنگي جوامع انساني خاصه جامعه ايران را مورد تأمل قرار دهد. ملاحظه گريدد كه نه تنها عدالت بر توسعه اجتماعي-فرهنگي تأثير مي‌گذارد بلكه چنين توسعه اي تنها در بستر عدالت ميسر است، از سوي ديگر، با توجه به اين كه مهم ترين موضوع مطرح شده در انقلاب اسلامي اجراي عدالت است، ارائه تحليلي علمي و نقادانه در اين زمينه، مؤثر ترين گام در تحقق عدالت و تأثير آن بر توسعه پيش گفته است.

Today, justice and its place are considered as a vital component in social development by theorists. After the revolution In Iran, Positive law is like a support by which we can realize "justice" in different affairs of society. Therefore, in this study, we considered the place of justice in social development with emphasis on Positive law. The main question is where the real place of justice is meaning to give right to the owner in cultural- social development. With the analytic- descriptive method, the study is aimed at considering the place of justice in cultural- social development of human societies, especially Iran by relying on positive law. We considered that not only justice has effect on cultural- social development, but the development is also possible only in this way. On the other hand, regarding that the most important issue considered in Islamic revolution was to perform justice, presenting critic and scientific Viewpoint on the subject is the most effective step toward realizing justice and its effects on development
