ﺑﺮرﺳﯽ راﺑﻄﮥ ﭘﺰﺷﮏ ﺟﺮاح و ﺑﯿﻤﺎر ﺑﺮ اﺳﺎس ﺗﻐﯿﯿﺮات اﺧﯿﺮ ﻗﻮاﻧﯿﻦ

Investigating the Relationship between Surgeon and Patient Physician Based on Recent Laws Changes

ﯾﮑﯽ از رواﺑﻄﯽ ﮐﻪ داراي آﺛﺎر ﺣﻘﻮﻗﯽ ﺑﻮده و ﺑﻪ واﺳﻄﮥ آن ﭘﺮوﻧﺪه ﻫﺎي ﻣﺨﺘﻠﻔﯽ در دادﮔﺴﺘﺮي، اﻋﻢ از دادﺳﺮا و دادﮔﺎه، ﺗﺸﮑﯿﻞ ﻣﯽ ﺷﻮد، راﺑﻄﮥ ﭘﺰﺷﮑﺎن ﺟﺮّاح و ﺑﯿﻤﺎر اﺳﺖ. اﯾﻦ راﺑﻄﻪ ﺑﻪ واﺳﻄﮥ اﯾﻨﮑﻪ داراي آﺛﺎر ﻣﻬﻢ ﺣﻘﻮﻗﯽ ﻣﯽ ﺑﺎﺷﺪ، اﻫﻤﯿﺖ ﺑﺎﻻﯾﯽ دارد. ﻗﺒﻞ از ﻗﺎﻧﻮن ﻧﻮﯾﺴﯽ ﻣﺪرن در اﯾﺮان اﯾﻦ راﺑﻄﻪ در ﻣﻨﺎﺑﻊ ﻓﻘﻬﯽ ﻣﻮرد ﺑﺤﺚ واﻗﻊ ﻣﯽ ﺷﺪ و رواﺑﻂ ﭘﺰﺷﮏ و ﺑﯿﻤﺎر در ﮐﺘﺐ ﻣﺨﺘﻠﻒ ﻓﻘﻬﯽ ﻣﻮرد ﺑﺮرﺳﯽ واﻗﻊ ﺷﺪه اﺳﺖ. ﭘﺲ از ﺷﺮوع ﻗﺎﻧﻮن ﻧﻮﯾﺴﯽ ﻣﺪرن ﻗﻮاﻧﯿﻦ ﻣﺨﺘﻠﻔﯽ ﺑﻪ ﻣﻨﻈﻮر ﺗﻨﻈﯿﻢ راﺑﻄﮥ ﭘﺰﺷﮏ و ﺑﯿﻤﺎر وﺿﻊ ﺷﺪ و اﯾﻦ ﻗﻮاﻧﯿﻦ ﺗﺎﮐﻨﻮن ﻣﻮرد اﺻﻼﺣﺎت و ﺗﻐﯿﯿﺮات ﻣﺨﺘﻠﻔﯽ واﻗﻊ ﺷﺪه اﻧﺪ. آﺧﺮﯾﻦ ﺗﻐﯿﯿﺮات ﻗﺎﻧﻮنﮔﺬاري در ﻗﺎﻧﻮن ﻣﺠﺎزات اﺳﻼﻣﯽ ﻣﺼﻮب 1392/02/01 ﺻﻮرت ﮔﺮﻓﺖ و ﺗﻐﯿﺮاﺗﯽ ﻧﺴﺒﺖ ﺑﻪ ﮔﺬﺷﺘﻪ در اﯾﻦ راﺑﻄﻪ اﯾﺠﺎد ﻧﻤﻮد. در ﮐﻨﺎر ﻗﺎﻧﻮن ﻣﺠﺎزات اﺳﻼﻣﯽ، ﻗﺎﻧﻮن ﺣﻤﺎﯾﺖ ﺧﺎﻧﻮاده ﻣﺼﻮب 1392 ﻧﯿﺰ در اﯾﻦ ﺧﺼﻮص ﻣﻘﺮراﺗﯽ وﺿﻊ ﻧﻤﻮده. ﻫﻤﭽﻨﯿﻦ ﻗﺎﻧﻮن ﻣﺴﺌﻮﻟﯿﺖ ﻣﺪﻧﯽ 1339 ﺑﻌﻨﻮان ﻗﺎﻧﻮﻧﯽ ﻋﺎم ﯾﮑﯽ از ﻣﻨﺎﺑﻊ رواﺑﻂ ﭘﺰﺷﮏ و ﺑﯿﻤﺎر ﺷﻨﺎﺳﺎﯾﯽ ﻣﯽ ﺑﺎﺷﺪ. در اﯾﻦ ﭘﮋوﻫﺶ ﻫﺪف ﺑﺮرﺳﯽ راﺑﻄﮥ ﭘﺰﺷﮏ ﺟﺮاح و ﺑﯿﻤﺎر ﺑﺮ اﺳﺎس آﺧﺮﯾﻦ ﺗﻐﯿﯿﺮات ﻗﺎﻧﻮﻧﮕﺬاري ﺑﻮد و ﺑﺮ اﺳﺎس ﻧﺘﺎﯾﺞ آن ﻗﻮاﻧﯿﻦ ﺟﺪﯾﺪ ﻧﺴﺒﺖ ﺑﻪ ﻗﻮاﻧﯿﻦ ﮔﺬﺷﺘﻪ ﺑﻪ واﺳﻄﮥ ﺧﻄﯿﺮ ﺑﻮدن ﺷﻐﻞ ﭘﺰﺷﮑﯽ ﺗﻮﺟﻪ ﻣﻨﺎﺳﺐ ﺗﺮي ﺑﻪ ﭘﺰﺷﮑﺎن ﺟﺮّاح داﺷﺘﻪ اﺳﺖ.

One of the relationships that have legal effect, through which there are various cases in the judiciary, including the prosecutor's office and the court, is the relationship between the surgeons and the patient. This relationship is important because it has important legal effects. Before modern lawmaking in Iran, this relationship was discussed in sources of jurisprudence and the relationship between doctor and patient was investigated in various jurisprudential books. After the introduction of modern lawmaking, various laws were introduced to regulate the relationship between the doctor and the patient, and these laws have been subject to various changes and changes. The last legislative changes in the Islamic Penal Code were adopted on February 1, 2013 and made changes in this regard. Along with the Islamic Penal Code, the Family Protection Act of 1392 has also introduced regulations in this regard. The Civil Liability Act of 1339 is also recognized as the general law of one of the sources of the relationship between a doctor and a patient. The aim of this study was to investigate the relationship between a surgeon and a patient physician based on the latest legislative changes, and according to the results, new laws were more appropriate to surgeons than past laws due to the importance of medical care.
