توجيه اِعمال مجازاتهاي اجتماعي بر مبناي تدرّج تعزير

Justification of community punishments' exercising on the basis of hierarchy of reactions

بررسي منابع فقهي حاكي از اين است كه تعيين واكنش تعزيري به تشخيص حاكم واگذار شده است. بي شك، تبيين نحوه‌ي عملكرد قاضي در تشخيص و تعيين مناسب‌ترين و مؤثرترين واكنش تعزيري، از موضوعات مهمّي است كه در پرتو آن مي‌توان جايگاه مجازات‌هاي اجتماعي در سياست كيفري اسلام را تبيين نمود. مقاله‌ي حاضر با اتخاذ روش توصيفي-تحليلي، اين مسأله را مورد بررسي قرار داده و به اين نتيجه رسيده است كه قاضي مكلّف به رعايتِ مراتب و درجات تعزير است و جهت حركت او در گزينش واكنش اصلح، از خفيف‌ترين واكنش‌ها به سمت شديدترين آن‌ها (الأسهل فالأسهل) مي‌باشد. اين امر به نوبه‌ي خود، گاهي مستلزم گزينش مجازات‌هاي اجتماعي است و لذا در مواردي كه مقتضاي تدرّج تعزير انتخاب مجازات اجتماعي است، به كار گيري اقدام يا عقوبتي غير از آن، مشروعيت نخواهد داشت.

An examination of the sources of Islamic jurisprudence demonstrates that determination of the discretionary punishment has been given to the expediency of judge. The explanation of the quality of recognizing discretionary punishment by judge, undoubtedly, is one of the important subject matters by which the community punishments' station in the Islamic criminal policy is demonstrated. The present study using a descriptive–analytical method, has examined the matter and has found out the judge should "observe" the hierarchy of reactions and His movement for Selection of the most advisable reaction should be from the most soft reactions to the most severe ones. This, in itself sometimes necessitates Selection of community punishments. Therefore, in situations that necessity of hierarchy's observance necessitating the selection of the community punishment, it is illegitimate to exercise another reaction.
