كشتي در حقوق بين ­الملل به اتكاي جسم فيزيكي خود، از موجوديت­هاي داراي مسئوليت نيست. مسئوليت فعاليت‌هاي او متوجه دولت صاحب پرچم است. كشتي در اِزاء اين مسئوليت سپاري، متعهد به تبعيت از مقررات دولت صاحب پرچم، دولت ساحلي و مقررات بين ­المللي راجع به دريانوردي و فعاليت­هاي ماهي­گيري است. دولت صاحب پرچم نيز در اِزاء اين تعهدپذيري مكلف به اعمال صلاحيت در امور كشتي مذكور است تا اين­كه به تعهدات بين­ المللي خود در حوزه­ هاي امنيت كشتي، حمايت و حفاظت از زيست محيط درياها و جلوگيري و مبارزه با صيد غيرمجاز عمل كرده باشد.
