پيشگيري و جبران خسارات ناشي از صيد غيرمجاز و آلودگي زيست محيط درياها

Prevention and Compensation the Damages Caused by Sea Environmental Pollution and Illegal Fishing its Live Resources

دولت­ها متعهد به حمايت و حفاظت از زيست محيط درياها هستند. دولت­ها بايد كليه­ ي اقدامات لازم را در اين زمينه بعمل آورند. پيشگيري، كاهش يا كنترل آلودگي ناشي از فعاليت­هاي دريايي، در صلاحيت دولت­هاي ساحلي است. دولت­هاي ساحلي با تصويب قوانين لازم بر پيشگيري، كاهش يا كنترل آلودگي زيست محيط درياها و صيد غيرمجاز منابع زنده­ي ناشي يا در ارتباط با فعاليت­هاي كشتي­ هاي خارجي در مناطق تحت حاكميت خود اقدام مي­كنند. مسئوليت نقض قوانين و مقررات دولت ساحلي و جبران خسارات ناشي از آلودگي زيست محيط درياها و صيد غيرمجاز منابع زنده ­ي آن از سوي كشتي­هاي خارجي برعهده ­ي دولت­هاي صاحب پرچم آن­ها قرار مي­گيرد. اين مسئوليت بخاطر فعاليت­هاي كشتي­ هاي حامل پرچم آن­ها در درياي سرزميني دولت ساحلي يا درياهاي آزاد مي­باشد، كه تحت كنترل و نظارت آن­ها قرار گرفته است.

The Government oblige to supporting and protecting the sea environmental. Governments shall take all appropriate measures. Prevent, reduce or control pollution caused by maritime activities is in jurisdiction of the coastal State. The coastal State with the adoption of the necessary laws on environmental pollution prevention, reduction or control of the sea environment and illegal fishing live resources caused by or in connection with the activities of foreign ships in areas under its sovereignty claim. Responsibility for violation of the laws and regulations of the coastal State and compensation for losses caused by environmental pollution and illegal fishing environment of live it resources from the flag State. It is the responsibility of flag State because of the activities of their vessels in the territorial sea of th e coastal State or the high seas, which is under his control and supervision
