Jurisprudential foundations for government responsibility towards derelict and ill-protected women

نظام جمهوري اسلامي ايران به عنوان شاكله ي اصلي و زمينه ساز تحقق تمدن اسلامي؛ ناگزير از توجه نظام مند به تمام مختصات حكومت اسلامي است؛ بخشي از اين مختصات مربوط به حل مسائل و مشكلات افراد نيازمند و توجه ويژه به زنان بي سرپرست و بدسرپرست است. نظر به اهميت نقش زنان در خانواده و جامعه، حمايت از اين گروه، ضروري و اجتناب ناپذير به نظر مي رسد، اما سوال اينجاست كه مباني فقهي مسئوليت حكومت در قبال اين گروه از زنان چيست؟ پژوهش حاضر با تكيه بر روش توصيفي–تحليلي و با استناد به ادله ي عام و خاص فقهي، به دنبال كشف شيوه ي مواجهه با اين پيامد اجتماعي از حيث انساني و فقهي است و از سوي ديگر به دنبال شناخت مسيرهايي است كه حكوت اسلامي در قبال اين پديده ي اجتماعي پيشنهاد داده است. نگاه حكومت اسلامي از لحاظ فقهي به اين زنان حاكي از نوعي باورداشت ويژه از كيفيت نقش آنهاست. اين نوشتار در پايان امر با توجه به مباني مورد نظر، لزوم بازنگري در قوانين جمهوري اسلامي ايران را اثبات و پيشنهاداتي را در اين باره مطرح مي كند.

Islamic Republic of Iran as a main constituents and fulfillment operator of Islamic civilization must systematically focus on the Islamic Government’s affairs. A part of these exclusive affairs involves the solutions regarding the problems of those in need; especially Particular attention to derelict and ill-protected women. According to the significant role of women in the family and society, it is essential and inevitable to protect them. The question is what are the Jurisprudential foundations for the government’s responsibility towards this group of women? This essay tries to explore humanistic and jurisprudential settlement of this social matter based on analytical – descriptive method and refers to General and special jurisprudential evidences. It is also looking for the Government’s suggestions for this social phenomenon. The jurisprudential approach of Islamic government to these women’s situation represents a kind of special assumption about the quality of their roles. In the end this research provides some evidences to the revision necessity in the Islamic republic of Iran’s law based on intended foundations and it proposes suggestions in this regard.
