چكيده فارسي :
اصولاً هر دولتي تنها مسئول اعمال متخلفانه خويش مي‌باشد، با اين حال در حقوق بين‌الملل نيز مانند حقوق داخلي، معاونت و همكاري در عمل متخلفانه دولت ديگر مي‌تواند موجبات مسئوليت يك دولت را به همراه داشته باشد. ازجمله مهم‌ترين تعهدات دولت‌ها در قبال مخاصمات مسلحانه، لزوم حفظ بي‌طرفي است. بايد اذعان داشت در طول جنگ تحميلي رژيم بعث عراق عليه جمهوري اسلامي ايران، تعدادي از كشورها در اين عمل متخلفانه به رژيم بعث عراق ياري رساندند. اين همكاري‌ها شامل سربازگيري و اعزام نيرو، آموزش نيروها با اهداف نظامي، اعطاي جنگ‌افزارهاي نظامي مختلف، بازگذاشتن مرزها، واگذاري بخشي از خاك براي احداث پايگاه‌هاي نظامي، اعطاي كمك‌هاي مالي نقدي و غيرنقدي، همكاري‌هاي فني و تكنولوژيكي و همچنين مساعدت اطلاعاتي از جمله جمع‌آوري اخبار و اطلاعات به نفع رژيم متخاصم عراق و به ضرر كشور جمهوري اسلامي ايران مي‌باشد. واكاوي و تأمل در سه ركن قانوني، مادي و معنوي به‌عنوان اركان ايجاد مسئوليت اشتقاقي كشورهاي حامي رژيم بعث عراق، حاكي از آن است كه كشورهاي مزبور از منظر قواعد و مقررات بين‌الملل مسئول شناخته شده و قابل تعقيب خواهند بود.
