جايگاه حقوق فردي شهروندي در فقه و نظام حقوقي ايران

Place of Inidividual Citizenship Rights in Iranian Jurisprudence and Legal System

حقوق فردي شهروندي يا ضوابط و قواعدي كه حقوق فرد و دولت و قلمرو اختيارات آنها را در برابر يك ديگر تعيين ميكند، از جمله مباحث مطرح و مهم جهان كنوني است. در حكومت اسلامي ايران نيز رابطه حقوقي فرد و دولت داراي جايگاه خاصي است و حقوق و امتيازات افراد به شكل مبسوطتري در قانون اساسي جمهوري اسلامي ايران تبيين گرديده و در اين خصوص طبعا و ذاتا ساكت نيست، زيرا مهم ترين منابع اختصاصي حقوق اساسي ايران برگرفته از فقه اسلامي است و بنياديترين بخش آن اعلام حقوق و آزاديهاي اساسي افراد است كه همسو با ارزشهاي اسلامي است، گرچه در قانون اساسي جمهوري اسلامي ايران واژه هاي شهروند و حقوق شهروندي به كار نرفته، ولي در عوض، از تعبيراتي چون حقوق ملت، حقوق عمومي، حقوق عامه، حقوق فردي اجتماعي چند بار استفاده شده است كه تبيين همه جانبه آن نيازمند تحقيق عميق و تفصيلي است، لذا اين پژوهش با اتخاذ روش تحليلي و توصيفي سعي بر آن دارد كه به تعيين جايگاه حقوق فردي شهروندان در فقه اسلامي و حقوق ايران، شناخت آن و نگاهي كوتاه به ضوابط و قواعد كلي مربوط به اين مقوله بپردازد.

Individual citizenship rights or the regulations and rules that determine the boundaries between individual rights and the jurisdictions of government are among the key discussions in the contemporary world. In Islamic government of Iran the relationship between individual rights and government is of specific place and individual rights have been explained in full details in the Constitution of Islamic Republic of Iran and it has not remained silent in this regard; because Iranian constitutional law is mainly driven from Islamic jurisprudence and its most important part is the delineation of the basic rights and freedoms of individuals which is in line with Islamic values. Although in the Constitution of Islamic Republic of Iran the terms citizen and citizenship rights have not been used there are still other relevant terms like nation's rights, public rights, general rights, individual and social rights which have been frequently used; needless to say, their comprehensive explanation requires deep and detailed research. Then, the current study seeks to determine the place of individual rights of citizens in Islamic jurisprudence and Iranian law and at the same time provide a short outline of its relevant general regulations and rules.
