مسئله اصلي در مقاله چيستي فقه حكومتي و بررسي «ابزارهاي اصلي براي فهم گزاره‌هاي ديني در فقه حكومتي» است. بر اساس نظريه نگرش سيستمي به دين در اين دستگاهِ معرفتي، «اجتهاد» عبارتست از «كشف الحكم عن مدركه» و «حكم» عبارتست از: «الاعتبار الشرعي المتعلق بأفعال العباد» داعيه تمدن‌سازيِ اسلام سبب شده است تا تلاش براي استخراج ديدگاه اسلام در مقياس جمعي و با رويكرد استخراج «فرآيندها»، مورد توجه جدي قرار بگيرد. ضرورت «حجت بودن» براي استناد به دين، سبب تمركز بر روش‌شناسيِ چنين تلاشي شده است. و نتيجه آن اتخاذ راهبردهاي 1- دين محوري منابع اطلاعات 2- دين استراتژيك 3-نگاه شبكه اي به هستي 4- پارادايم محوري بر اساس پارادايم شبكه اي دين 5- موضوع‌شناسي و مساله‌شناسي در تمام لايه‌هاي هرم نيازها 6- تعيين مرزهاي سيستم بر اساس شبكه اهداف دين 7- منطق اجتهاد جواهري 8- گسترش هويت «حكم» 9- گسترش هويت «وضع» 10- منطق فقه تفريعي در تطبيق 11 - استفاده منطق سيستم‌ها در جمع دلالي در مراحل عملياتي زير ميباشد: 1- توليد شبكه مسائل و موضوعات زندگي 2- توليد فرآيندهاي پاية سيستم 3- توليد ماتريس كليدواژه‌ها 4- عمليات تحليل گزاره‌ ها 5- ترجمه گزارة دين به زبان فرضيه علمي 6- موقعيت‌يابي فرضيه در الگوي پيشرفت و نقشه تمدني.

The main issue in the article is the essence of government jurisprudence and the study of “main tools for understanding religious propositions in government jurisprudence”. According to the theory of systemic attitudes toward religion in this epistemic system, “ijtihad” is the “discovery of al- Hakam al-Maderka” and “the verdict”, namely: "Al-'Aṭṭīr al-Shā'ī al-Metāqlā bāfā al-alābād". The claim of the civilization of Islam has led to an attempt to derive the viewpoint of Islam on a collective scale, with the approach of extracting “processes” to be taken seriously into account.
