The Role of Information Technology in Declarative Function of Documents and Real Estates Registration Organization

ضرورت تامين «كاركرد اطلاع رساني» به عنوان يكي از كاركردهاي حقوقي سيستم هاي ثبتي در دنيا از يك سو، و تمايل به ايجاد دولت الكترونيك براي ارائه خدمات عمومي بهتر و تسريع و تسهيل اطلاع رساني از سوي ديگر، سبب توجه كشورها به بحث فناوري اطلاعات در سيستم هاي ثبتي گرديده و اين مساله را مطرح مي سازد كه چگونه فناوري اطلاعات بر بهبود كاركرد اطلاع رساني سيستم هاي ثبتي تاثير گذاشته و تا چه ميزان خلاء هاي حقوقي اين سيستم ها را پر مي كند؟ پژوهش حاضر با ديدگاهي تحليلي و تطبيقي به اين نتيجه دست يافته است كه فناوري اطلاعات صرفا بر تسهيل و تسريع بعد دوم كاركرد اطلاع رساني سيستم ثبتي يعني «دستيابي به اطلاعات» موثر بوده لكن در تضمين صحت اطلاعات ثبت شده كه مرتبط با نوع سيستم ثبتي اتخاذي توسط كشورها مي باشد و در اصل «حق دسترسي به اطلاعات » فاقد تاثير است و لذا اتخاذ سياستي حياتي است كه تغييراتي را ايجاد كند كه براي شهروندان امكان دسترسي به همه اطلاعات لازم براي كاهش ريسك معاملاتي در خصوص اموال و وضعيتهاي حقوقي ثبت شده در لحظه انعقاد معامله را فراهم كند و علاوه بر آن قابليت اطمينان و صحت و دقت در اطلاعات ثبتي را تضمين كند.

The need to provide "declarative function" as one of the legal functions of the registration systems all over the world on the one hand, and the desire to create e-government on the other hand, has led that countries Pay attention to information technology in the registration systems. The matter is “how is information technology affecting on the declarative function of registration systems and how much does it can fill the legal system s gaps”. The study, with an analytical and comparative approach, has concluded that information technology has been effective only on facilitating and expediting "access to information", but it has been uneffected in ensuring the accuracy of the registred information, which is related to the type of registration systems and to the principle of “acces right to information". Therefore, it is vital to make a policy that will allow citizens to have access to all necessary information to reduce the trading risk in the property and recorded legal status at the moment of the transaction. In addition, it is vital to guarantee the reliability and accuracy of the recorded information.
