ارزيابي ادغام نهادهاي حمايتي از منظر حقوق موضوعه:سازمان بهزيستي، بنياد مستضعفان و كميته امداد امام خميني (ره)

Legal Evaluation of Merging Supporting Organizations in Acts and Regulation: Behzisti Organization, Mostazafan Foundation and Imam Khomeini Comiittee

سازمان بهزيستي، كميته امداد و بنياد مستضعفان، سه نهاد حمايتي حكومتي با وظايف مشابهي مثل حمايت از خانواده هاي نيازمند، كودكان، سالمندان و آسيب ديدگان اجتماعي هستند؛ اما فعاليت موازي با وظايف مشابه، سواي مغايرت با موازين حكمراني و اداره خوب و اصول متعدد قانون اساسي، به ويژه وظايف و اختيارات رهبري؛ در اين مقاله از منظر حقوق موضوعه واكاوي شده و در مقام نتيجه، اهداف و وظايف مشابه تقريبا منطبق با اين سه نهاد، حاكي از امكان ادغام آنها در يكديگر است. درحال حاضر، وظايف فراحمايتي بنياد و كميته، موجب ورود آنها به عرصه اقتصاد و مآلا نفوذ سياسي آنها شده است؛ همچنين وظايفي چون حمايت از افراد داراي معلوليت، محرومان خارج از كشور و جمع آوري و هزينه كرد زكات، از تفاوت هاي اين سه نهاد هستند؛ از اين رو طبق حقوق موضوعه، ادغام آنها در سازمان بهزيستي، فرجام اين پژوهش است: تلاشي براي چابكي حكومت، كاهش تورم قوانين و مقررات، پاسخگو كردن اين نهادها و از همه مهم تر؛ بهبود كيفيت، يكسان سازي و شفافيت خدمات حكومت به شهروندان در اين عرصه.

Behzisti Organization, Mostazafan Foundation and Imam Khomeini Comiittee are 3 governmental supporting organizations with similar duties that were established with the purpose of supporting from poor and needy classes of society, children and socially damaged persons. Nevertheless, parallel activities with similar duties is in contradiction with several principles of the constitution and good governance. On the other hand, the status of committee and foundation in contradiction with constitution of Islamic Republic of Iran. the activities of these 2 Organizations is in contradiction with duties and scope of powers of leadership as recommended in the 110th principle of the constitution law.Thus, the subject of activities of these 2 organizations, if firstly has executive nature and secondly has supporting and economic nature that is not covered among 11 clauses of 110th principle of the constitution. The similar duties and goals based on these 3 organizations refers to merging them. At the present time, the beyond supporting duties of foundation and committee leads to their entrance into economic fields and improving their economic and political influence. Some of these supporting and duties are including: Serving to persons with disability, supporting from deprived persons out of Iran and collecting zakat is among differences in goals of these 3 organizations. On this basis, through depending on the constitution of Islamic Republic of Iran and statute law, the final goal of the present research is to merging them into Behzisti organization.This is an attempt for compatibility of rules of good administration constitution, downsizing the government, reducing rules and regulations, improving responsiveness of these association and quality, unifying and clarity of government services to citizens.
