ﻧﻘﺪ و ﺑﺮرﺳﯽ ﻣﺪل ارﺗﺒﺎط ﺷﺒﮑﻪاي ﻣﯿﺎن دادﺳﺮا و ﭘﻠﯿﺲ در ﻓﺮاﯾﻨﺪ ﮐﯿﻔﺮي

Study of the Network Relation Model between the Prosecution Service and the Police in the Criminal Process

رواﺑﻂ ﻣﯿﺎن دادﺳﺮا و ﭘﻠﯿﺲ از ﻣﺆﺛﺮﺗﺮﯾﻦ رواﺑﻂ ﻣﯿﺎن ﻧﻬﺎدﻫﺎي اﺟﺘﻤﺎﻋﯽ در ﻣﺪﯾﺮﯾﺖ ﺟﺮم ﻣﯽﺑﺎﺷﺪ. اﯾﻦ رواﺑـﻂ ﻣﺘﻨﺎﺳﺐ ﺑﺎ ﻧﻈﺎم دادرﺳﯽ از ﻣﺪلﻫﺎي ﻣﺘﻔﺎوﺗﯽ ﭘﯿﺮوي ﻣﯽﮐﻨﺪ. اﯾﻦ ﻧﻮﺷـﺘﺎر ﺑـﺎ اﺳـﺘﻔﺎده از اﺳـﺘﺮاﺗﮋي ﺗﺤﻠﯿـﻞ ﻣﻨﻄﻘﯽ و روش ﮐﺘﺎﺑﺨﺎﻧﻪاي ﺑﻪدﻧﺒﺎل ﻣﻌﺮﻓﯽ ﻣﺪل ارﺗﺒﺎﻃﯽ ﺷﺒﮑﻪاي ﮐﻪ ﺳﺎزﻣﺎﻧﺪﻫﯽ آن ﻣﺘﻨﺎﺳﺐ ﺑﺎ ﻣﺎﻫﯿﺖ ﻧﻈﺎم دادرﺳﯽ اﺗﻬﺎﻣﯽ اﺳﺖ، ﻣﯽﺑﺎﺷﺪ و در ﻫﻤﯿﻦ راﺳﺘﺎ ﺑﻪ ﺗﺒﯿﯿﻦ ﻣﺆﻟﻔﻪﻫﺎ و ﭘﯿﺎﻣﺪﻫﺎي اﯾﻦ ﻧﻮع از رواﺑﻂ ﻣـﯽ ﭘـﺮدازد. ﭼﻨﯿﻦ راﺑﻄﻪاي ﺑﺮ ﻧﻮﻋﯽ ﺗﻌﺎﻣﻞ ﻫﻢﺳﻄﺢ و ﭘﯿﻮﻧﺪ ﺷﺒﮑﻪاي ﺑﺮﻗﺮار ﮔﺮدﯾﺪه و ﺑﺮﺧﻼف ﻧﻈـﺎم ﺗﻔﺘﯿﺸـﯽ اﺳـﺖ ﮐـﻪ ﻣﻨﺠﺮ ﺑﻪ ﺷﯿﻮه ﺳﻠﺴﻠﻪﻣﺮاﺗﺒﯽ ﻣﯿﺎن دادﺳﺮا و ﭘﻠﯿﺲ ﺷﺪه اﺳﺖ. ﻣﻮﻟﻔﻪﻫﺎي ﻣﺪل ﺷﺒﮑﻪاي ﻋﺒﺎرﺗﻨﺪ از: اﺧﺘﯿـﺎرات ﮔﺴﺘﺮده و آﻏﺎزﯾﻦ ﭘﻠﯿﺲ، اﺧﺘﯿﺎرات ﻣﺤﺪود و ﺛﺎﻧﻮﯾﻪ دادﺳﺮا و رواﺑﻂ اﻓﻘﯽ ﭘﻠﯿﺲ و دادﺳﺮا. ﺑﻪ ﻧﻈﺮ ﻣﯽرﺳﺪ اﯾﻦ ﻣﺪل رواﺑﻂ ﺑﻪ ﻣﺜﺎﺑﻪ ﯾﮏ ﻣﻮﺟﻮد ﭘﻮﯾﺎﺳﺖ و از ﻇﺮﻓﯿﺖ ﻗﺎﺑﻞ ﺗﻮﺟﻬﯽ ﺑﺮاي ﺗﻄﺒﯿﻖ ﺑﺎ ﻣﺤﯿﻂ ﭘﯿﺮاﻣـﻮن ﺑﺮﺧـﻮردار اﺳﺖ و ﻣﯽﺗﻮان از ﻇﺮﻓﯿﺖﻫﺎي آن ﺑﺮاي ﺑﻬﺒﻮد ﻣﺪل رواﺑﻂ ﺳﻠﺴﻠﻪﻣﺮاﺗﺒﯽ ﻧﯿﺰ ﺑﻬﺮه ﺑﺮد.

The relationship between the prosecution service and the police is one of the most effective relationships between social institutions in crime management. These relations follow the distinctive models in accordance with the ruling system (accusatorial or inquisitorial). The accusatorial system has governed the network model of prosecution service and police relations. This paper deals with the descriptive-analytical method to introduce the network model, components of the network relations model of the prosecution service and the police and ultimately criticizes it. This relationship is based on a type of interoperability and network linkage, and is contrary to the inquisitorial system that has led to a hierarchical approach between the prosecution service and the police. This study will provide an introduction to the feasibility of developing the components of this model to the police and prosecution service relations in Iran's criminal justice system and to improve the governing model
